All self‑defense and personal safety products sold by XodusTrust are designed and sold solely for personal, non‑lethal deterrent purposes. They are intended to create a temporary distraction, loud alert, or non‑violent barrier that may provide an opportunity to escape a dangerous situation. XodusTrust makes no guarantees, representations, or warranties that any product will prevent harm, injury, or death. No product is 100% effective in all situations, and the outcome depends on numerous factors beyond our control, including the user’s reaction, the assailant’s behavior, and environmental conditions.

2. User’s Legal Responsibility

It is the sole responsibility of the purchaser and/or user to know and comply with all applicable federal, state, county, and local laws regarding the purchase, possession, carrying, and use of any self‑defense product. Laws vary widely — for example, pepper spray may be legal in one state but illegal in certain cities or buildings. Some states require a permit, restrict container size, or limit the concentration of active ingredients. Ignorance of the law is not an excuse, and XodusTrust assumes no liability for any legal consequences resulting from the possession or use of our products in violation of applicable law.

3. Assumption of Risk

Use of any self‑defense product involves inherent risks. By purchasing and using our products, you voluntarily assume all risks, known and unknown, including but not limited to:

  • Accidental discharge or activation causing injury to yourself or bystanders.
  • Improper use that fails to deter an attacker.
  • Injury resulting from training or handling.
  • Property damage (e.g., staining from pepper spray).
  • Adverse health effects (e.g., allergic reaction, respiratory issues from irritants).

You agree that XodusTrust, its parent company Yingkou Tingbang Clothing Trading Co., Ltd., its officers, employees, and affiliates shall not be held liable for any personal injury, death, property damage, or any other loss arising from the use or misuse of our products.

4. Training and Responsible Use

We strongly recommend that you seek proper training before carrying or deploying any self‑defense tool. Understanding how to use the product safely and effectively is your responsibility. Always follow the manufacturer’s instructions provided with the product. Keep all safety products out of the reach of children and pets.

5. Product‑Specific Warnings

  • Personal Safety Alarms: Sound levels above 120 decibels can cause hearing discomfort or damage if activated near the ear. Never activate the alarm near infants, pets, or individuals with sensitive hearing without appropriate caution.
  • Pepper Spray / Bear Spray: Bear spray is formulated exclusively for deterring aggressive bears and is regulated by the EPA. It is illegal to use bear spray on humans except in an emergency self‑defense situation where no other option exists, and doing so may still result in legal consequences. Standard pepper spray intended for self‑defense is not the same and should never be used on animals unless there is an immediate threat.
  • Cut‑Resistant Gloves / Protective Apparel: These items provide cut resistance, not cut proofness. They reduce the risk of injury but do not eliminate it. Always assess the situation and never rely solely on protective gear for safety.

6. Limitation of Liability

To the fullest extent permitted by law, XodusTrust’s total liability for any claim arising from a purchased product, whether in contract, tort (including negligence), strict liability, or otherwise, shall not exceed the purchase price paid for that specific product. Under no circumstances shall XodusTrust be liable for indirect, consequential, incidental, special, or punitive damages.

7. Indemnification

You agree to indemnify, defend, and hold harmless XodusTrust and its affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use or misuse of our products, your violation of any law, or your breach of this Disclaimer.
